The petitioner seeks bail in Kudhani P.S. Case No. 261 of 2014, corresponding to Sessions Trial No. 46 of 2015, registered for the offences punishable under Sections 307, 326 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.
Learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier rejected vide order dated on 19.03.2015 passed in Cr. Misc. No. 48897 of 2014. The petitioner is in jail since 30.08.2014 and the petitioner has already remained in jail for about two years and six months. The witnesses except the investigating officer and the doctor have already been examined and the witnesses did not support the case of the
Patna High Court Cr.Misc. No.2911 of 2017 (2) dt.22-02-2017 2/2 prosecution.
Having considered the facts aforesaid and the fact that the petitioner has already remained in jail for more than 21⁄2 years, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the 10th Additional Sessions Judge, Muzaffarpur in Kudhani P.S.
