The petitioner is accused in connection with Bariyarpur P.S. Case No. 125 of 2016, registered under Section 30(A) of the Bihar Excise (Amendment) Act, 2016. The accusation is that in course of checking of the vehicle, a Maruti car was searched, which was driven by this petitioner. 240 bottles, each containing 375 ML and 48 bottles, each containing 750 ML India made foreign liquor were recovered.
Learned counsel for the petitioner submits that petitioner is the driver of the said vehicle and he has falsely been implicated in this case. The petitioner has no criminal antecedent
Patna High Court Cr.Misc. No.4791 of 2017 (2) dt.28-02-2017 2/2 is in custody since 24.11.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Bariyarpur P.S. Case No. 125 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
