Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek bail in connection with

Patna High Court CR. MISC. No.70603 of 2021(3) dt.13-10-2022 2/3 Chakand P.S. Case 116 of 2021 registered for the offence punishable under Sections 302, 328, 120(B) and 379 of the Indian Penal Code.

As per prosecution case, accusation against the petitioners is that petitioners alongwith others have concertedly poisoned informant's son namely Deepak Kumar as a result of which he died.

Learned counsel for the petitioners submits that petitioner namely Sunil Kumar alias Madhusudan Kumar is in custody since 05.07.2021 and petitioner namely Karun Paswan alias Kairun Paswan is in custody since 02.09.2021. Petitioners bear no criminal antecedent. The allegation against the petitioners is false and fabricated. The learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioners. He further submits that the allegation of poisoning is supported and corroborated with the FSL report.

Considering the facts and circumstances of the case as well as allegation leveled against the petitioners coupled with the FSL report and material available on record and considering these aspects of the matter, I am not

Patna High Court CR. MISC. No.70603 of 2021(3) dt.13-10-2022 3/3 inclined to grant bail to the petitioners. Accordingly, the prayer for bail of the petitioners is hereby rejected. However, the trial court is directed to expedite the trial as early as possible.
