JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 290 of the Indian Penal Code and Sections 47, 49, 54, 57 and 63 of the Bihar Excise (Amendment) Act, 2016.

The trial court has reported that charge against the petitioner has already been framed, but uptill now no prosecution witness has been examined.

Considering the aforesaid report as well as recovery made from the house of the petitioner, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in

Patna High Court Cr.Misc. No.3826 of 2017 (3) dt.29-03-2017 2/2 connection with Cheriya Bariyarpur P.S. Case No. 62/2016, pending in the court of the learned Additional Chief Judicial Magistrate, Manjhaul, Begusarai stands rejected. However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably within three months from the date of receipt/production of a copy of this order, failing which, the petitioner may renew his prayer for bail before the learned trial court itself.
