JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Araria (R.S) P.S. Case No. 350 of 2016, registered under Sections 272, 273/34 of the Indian Penal Code, Section 27(b)(ii), 28 of Drugs and Cosmetic Act and Section 22/25 of Narcotics Drugs and Psychotropic Substance Act.

The accusation is that petitioner being the Drug Inspector, Araria received information about accident of the Scorpio vehicle on which Codeine Phosphate are loaded. Thereafter, he reached on N.H. 57 near Hadiyabara. From the said Scorpio vehicle, 1100 Parvo-Cof, each containing 100 ML and 710 bottles of Corex each containing 100 ML were recovered in presence of Officer-In-Charge, Araria. Thereafter,

Patna High Court Cr.Misc. No.2301 of 2017 (2) dt.28-01-2017 2/2 the seizure-list was prepared. One pocket diary was also found in the said vehicle in which the name of one Rinku of village Sisona, Araria was mentioned.

Learned counsel for the petitioner submits that the petitioner has been implicated in this case mere on suspicion as one pocket diary was recovered from the said vehicle on which the name of the petitioner of village Sishona was detailed without parentage details and in course of investigation, driver of the vehicle also disclosed the same facts that seized cough syrup was loaded by Rinku of Sishona village, except that there is nothing against the petitioner to show his involvement in the present case and the petitioner is in custody since 11.11.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Araria in connection with Araria (R.S) P.S. Case No. 350 of 2016.
