Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 384/34 of the Indian Penal Code.
It is alleged that Munna Mishra used to demand extortion of Rs.5,00,000/- from the informant through mobile. Subsequently, the informant came to know that the petitioner along with Rajendra Singh, Dhanpal Singh, Rampal Verma, Harendra Singh and Jitendra Singh used to demand extortion. It is submitted by the learned counsel for the petitioner that investigation has still not concluded and accusation is based only on suspicion. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.1659 of 2016 (2) dt.13-01-2016 This Court is not inclined to interfere, since the case was registered in 2008, but considering the nature of accusation, this is a case for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bhorey P.S. Case No. 27 of 2008, pending in the court of learned Sub-Divisional Judicial Magistrate, Gopalganj.
With the above observation this application is disposed of.
