2. The petitioner seeks bail in connection with Govindganj (Malahi) P.S. Case No. 36 of 2023 registered for the offence under Sections 409, 420 read with Section 34 of the Indian Penal Code, 1860.

3. The accused/petitioner is named in the F.I.R. and is in custody since 11.08.2025.

4. As per FIR, petitioner being Manager of Chintamandpur PACS Chatia, District East Champaran alongwith co-accused persons are said to have committed irregularity in paddy procurement for the sessions 2021-2022.

5. Learned counsel appearing on behalf of the petitioner submitted that the maximum allegation against petitioner is to

Explaining this allegation, it is submitted by learned counsel that in fact petitioner being manager approved the purchase of the paddy in issue from the farmer and the alleged five persons were also found during investigation as registered farmer. It is also pointed out that the purchase of paddy on behalf of PACS was not to be approved by this petitioner only being manager, rather same was procured under approval of purchase committee of the PACS. While concluding argument, it is submitted that investigation of this case is already completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence. Petitioner claimed clean antecedent.

6. Learned APP opposed the prayer of bail.

Considering the aforesaid factual submissions and by taking note of overall nature of accusations as discussed aforesaid, coupled with the fact that investigation of this case is already completed, where petitioner being man of clean antecedent, remains in custody since 11.08.2025 accordingly, petitioner above named, is directed to be released on bail in connection with Govindganj (Malahi) P.S. Case No. 36 of 2023, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of
