JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that 200 litres country made liquor and 2000 kg. mahua which had been destroyed, were recovered from the house of the petitioner, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Excise Case No. 35 of 2014 pending in the court of Sri Tej Pratap Singh, Judicial Magistrate 1st Class, Gaya stands rejected.
Since petitioner does not have any criminal antecedent and it appears that he happens to be first offender, the learned trial court is directed to expedite the trial of the petitioner
Patna High Court Cr.Misc. No.54222 of 2015 (2) dt.03-12-2015 2/2 and try to conclude the same as early as possible, preferably within two months from the date of receipt/production of copy of this order, failing which the concerned court shall release the petitioner on bail fixing the amount of bail bonds on its own level.
