The petitioners seek pre-arrest bail in connection with Complaint Case No. 174 (C) of 2015 registered under Sections 323, 341, 379, 420/34 of the Indian Penal Code. It is contended that entire allegation made in the
Patna High Court Cr.Misc. No.2126 of 2016 (2) dt.18-01-2016 2/2 complaint are false and frivolous. The co-accused Mridula Pal @ Mridula Devi having more or less identical allegation has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 06.01.2016 passed in Cr. Misc. No. 140 of 2016.
A web copy of the aforesaid order has been brought on record by the leaned counsel for the petitioners in course of arguments. Let the same be kept on record.
Regard being had to the nature of the offences and the reasons assigned in the aforesaid order dated 06.01.2016 passed in Cr. Misc. No. 140 of 2016, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in Complaint Case No. 174 (C) of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
