JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 304B/201/34 of the Indian Penal Code.
Petitioner is husband. Allegation is of commission of death for non-fulfilment of the dowry demand. Petitioner is in custody since 22.04.2016. The report of the learned trial Judge dated 29.03.2017 reveals that last prosecution witness P.W.1 was examined on 23.01.2017. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount
Patna High Court Cr.Misc. No.3574 of 2017 (4) dt.10-04-2017 2/2 each to the satisfaction of learned Additional Sessions Judge-IV, Barh, Patna/Successor Court, in connection with S.T. No.589 of 2016/672 of 2017 arising out of Bhadaur P.S. Case No.37 of 2016, with condition that both the bailors shall be local residents and further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
