Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Sugauli P.S. Case No. 442 of 2020 for the offence punishable under Sections 147, 149, 341, 323, 324, 354-B, 342, 504 and 506 of the Indian Penal Code and under Section 9/10 of the POCSO Act.

It is being submitted by learned counsel for the petitioner that compromise between the parties has already been taken place.

Considering the aforesaid fact, this bail application is allowed.

No.21250 of 2021(2) dt.09-12-2021 2/2 Let the petitioner, above named, in the event of his his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO, Motihari, East Champaran, in connection with Sugauli P.S. Case No. 442 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. However, the Court below before accepting the bail bonds of the petitioner would verify the compromise petition and if it is found to be genuine, the Court below would accept the bail bonds of the petitioner and if the compromise petition is not found to be genuine or nor supported by the other side then the Court below would not accept the bail bonds of the petitioner.
