JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 406, 420, 504/34 of the Indian Penal Code. The accusation is of realizing Rs. 3,00,000/- on promise to provide employment in the railway but neither employment was provided nor money was returned and when demand was made then informant was abused.
It is submitted by learned counsel for the petitioners that at earlier point of time the wife of petitioner No. 1 filed Complaint Case No. 328(C) of 2015 against the informant and one Assistant Sub-Inspector of Police wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 341, 323, 448, 354, 385, 379/34 of the Indian Penal Code. Hence, as a retaliatory measure the present case has been lodged. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.2730 of 2016 (2) dt.18-01-2016 2/2 petition that petitioners have no criminal antecedent. Considering the nature of accusation when the case lodged by the petitioners' side is at earlier point of time, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Barh P.S. Case No. 317 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
