Petitioner is languishing in custody since 11.04.2017 in connection with Karpi P.S. Case No. 44/16 for offences punishable under Sections 302, 201, 120-B/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that his daughter Ruby Kumari was married to the petitioner in the year 2004, the petitioner along with family members used to torture her and eventually burnt her to death and disposed of the dead body for non-fulfillment of demand of dowry. It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.29556 of 2017 (3) dt.08-08-2017 2/2 petitioner that he is innocent and has been falsely implicated in the aforesaid case. He submits that, in fact, the deceased died while making tea and there was no demand of dowry ever. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, I am not inclined to grant privilege of bail to the petitioner at this stage in connection with Karpi P.S. Case No. 44/16, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.

Application is, accordingly, rejected.
