15-02-2017 Heard Sri S.N.P. Sinha, learned senior counsel assisted by Sri Nalin Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor.

This is the 2nd attempt for grant of bail on behalf of petitioner. Earlier, the prayer for bail of the petitioner was rejected, vide order dated 16-08-2016 passed in Cr. Misc. No. 31908 of 2016 (Annexure - 1 to the petition). Learned senior counsel submits that earlier, while rejecting the prayer for bail, this Court had observed that prayer for bail was being rejected for the moment. Meaning thereby that now the petitioner has already remained in custody for more than nine months. It has been indicated that all other accused in the present case have already been enlarged on bail. Even one accused

Patna High Court Cr.Misc. No.3340 of 2017 (2) dt.15-02-2017 2/2 has been extended the privilege of anticipatory bail by the court below itself.

In view of observation given by this Court in earlier bail petition, there is no reason to further detain the petitioner. Let the petitioner namely Lakshman Rai be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri B.B.Rai, learned Judicial Magistrate 1st Class, Chapra in connection with Chapra Town P.S. Case No. 277 of 2014. (Rakesh Kumar, J.) Anay U T
