JUSTICE SANJAY PRIYA ORAL ORDER 06-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 406, 409 and 420 of the Indian Penal Code.

As per written report, the beneficiaries of Gram Panchayat Devipur have taken twice the benefits of Indra Awas Yojana by filing a wrong affidavit in conspiracy with the then Panchayat Secretary and on his identification the petitioner worked as a middle man in those transactions. It has been submitted on behalf of the petitioner that he is Class-IV employee in Raghopur Block. He has no concern with any of those transactions. From the written report itself it appears that there is no allegation of overt act against the

Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Raghopur P.S. Case No. 208 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur (Supaul), subject to the conditions as laid down under Section 438 (2) Cr. P.C.
