JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 22.08.2015 on the accusation that he along with others assaulted the informant and others. There are several litigations between the parties and both the parties have filed cases against each others not only in respect of the present occurrence but prior to institution of the present case. The impugned order does not reflect as to whether any injured of the present case sustained any grievous injury on the vital part of the body and it appears that learned Additional Sessions Judge rejected the prayer only taking note of the antecedent of the petitioner but he failed to take note of this fact that almost all the cases registered against the petitioner were

Patna High Court Cr.Misc. No.54433 of 2015 (2) dt.07-12-2015 2/2 lodged by the prosecution party of this Case. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Muzaffarpur in connection with Sakra P.S.Case No. 486 of 2014.
