JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of petitioner came in this case in confessional statement of co-accused Sonu Burnwal@ Vikas Kumar Bharti as is evident from perusal of the impugned order itself. Co-accused Sonu Burnwal@ Vikas Kumar Bharti has already been granted privilege of bail by a co-ordinate Bench of this Court.

Learned counsel appearing for the petitioner drew my attention towards order dated 15.10.2015 passed in Cr. Misc. No. 27939 of 2015 and analogous cases pointing out that the victim has also not named the petitioner in his statement recorded under section 164 of the Cr.P.C.

Accordingly, let the petitioner, above named, be

Patna High Court Cr.Misc. No.54441 of 2015 (2) dt.07-12-2015 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Jamui in connection with Jhajha P.S.Case No. 18 of 2015.
