JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-10-2016 Petitioner is languishing in custody since 22.3.2010 in Trial No.46 of 2010 arising out of Mainatand P.S. Case No.15 of 2010 registered for the offences under Sections 20, 21, 22 and 23 of the N.D.P.S. Act.

The prosecution case is that while police personnels were conducting raid to arrest the accused of Mainatand P.S. Case No.14 of 2009 in the meantime, they got confidential information that some smugglers with ganja are hiding in the house of Brichha Yadav. As soon as they reached there, 8-10 persons started fleeing away towards river and on chase, they were apprehended and 10 packets of ganja kept in a gunny bag total weighing 161.400 kg. were recovered.

Patna High Court Cr.Misc. No.41704 of 2014 (5) dt.26-10-2016 2/2 The report of the S.P., West Champaran, Bettiah dated 1.2.2015 reflects that case had been at the stage of argument. It is submitted by the learned A.P.P. that the trial must have been concluded by now.

Neither the counsel for the petitioner nor the counsel for the State has been able to convey to this Court whether trial has concluded or not.

Considering the present stage of the trial, this Court is not inclined to keep the application pending. The application stands disposed of.

If the trial has not been concluded, it is expected from the learned Special Judge, N.D.P.S., West Champaran at Bettiah to conclude the same expeditiously.
