JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sultanganj P.S. Case No. 264 of 2018 registered for the offences punishable under Sections 341, 323, 307, 498A, 506, 379 and 34 of the Indian Penal Code.

Allegation against the accused persons, including the petitioner is of assaulting the informant with respect to demand of Rs.3 lakh.

Submission of learned counsel for the petitioner is that earlier also a case under Section 498A IPC was registered and in that case he has been granted privilege of anticipatory bail on 10.8.2018 and

Patna High Court Cr.Misc. No.9496 of 2019(2) dt.19-02-2019 2/3 thereafter the present case has been filed on 21.9.2018 making allegation of assault and demand but no injury report is available on record.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail on the ground that this separate case has been lodged by the informant.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna City, in connection with Sultanganj P.S. Case No. 264 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the
