JUSTICE SHIVAJI PANDEY ORAL ORDER 06-07-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceeding. In this case, the petitioner is seeking regular bail in connection with Raniganj P.S. Case No.359 of 2019, registered for the offence under Sections 302/201/34 of the Indian Penal Code.
An F.I.R. has been lodged by the brother of the victim that his sister has been killed by Subodh Nonia and other coaccused persons and for disappearance of the dead-body they have burnt the same.
I have perused the case diary, which had been called for by this Court. From perusal of the same, it appears that some unknown persons have picked up the son of Subodh
Patna High Court CR. MISC. No.8329 of 2020(4) dt.06-07-2020 2/3 Nonia, on that account, some villagers assembled, dragged the victim lady and killed her and thereafter they have burnt the dead-body.
Learned counsel for the petitioner submits that no specific allegation has been made against this petitioner, inasmuch as, co-accused Amit Nonia has been granted bail by this Court in Criminal Miscellaneous No. 12125 of 2020, coaccused Subodh Nonia has been granted bail in Criminal Miscellaneous No. 9282 of 2020, co-accused Harendra Nonia has been granted bail in Criminal Miscellaneous No.14403 of 2020 and co-accused Hari Narayan Nonia and Kanhaiya Nonia have been granted bail in Criminal Miscellaneous No. 8105 of 2020, so the present petitioner should also be granted bail by this Court.
Considering the fact that altogether 14 persons have been named in the F.I.R. and large number of accused persons have been granted bail by this Court, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria, in connection with Raniganj P.S. Case No. 359 of 2019. However, looking to the nature of allegation made
