Having regard to the nature of allegation against the petitioner for offence under section 302 and other allied offences of the Indian Penal Code and section 27 of the Arms Act and 17 of the Criminal Law Amendment Act and that the report of the Sr. Superintendent of Police, Patna dated 4.9.2014 indicates that not only the trial of the petitioner in connection with Masaurhi (Bhagwanganj) P.S.Case No. 7/2003 (S.Tr.No. 135 of 2011/ R1135 of 2014) has commenced, wherein two out of seven witnesses are already examined as on 4.9.2014, this Court is now not inclined to grant regular bail to the petitioner. The trial court, however, is directed to ensure that the trial of the petitioner is completed within a period of nine months from the date of receipt of this order. The Sr. Superintendent of Police,
Patna High Court Cr.Misc. No.30711 of 2014 (3) dt.29-07-2015 Patna is also directed to ensure that the remaining prosecution witnesses in connection with the aforementioned case, if not examined till today, must be produced before the trial court within a period of four months from the date of receipt of this order. The trial court must make its all endeavour to complete the trial within the aforesaid period of nine months.
With the aforementioned observation, this application is disposed of.
Let a copy of this order be sent not only to the trial court but also to the Sr. Superintendent of Police, Patna for its compliance in letter and spirit.
