JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to the prosecution case itself, deceased died within one year of her marriage in other than normal circumstances. The doctor found the deceased died of asphyxia due to strangulation. There is allegation of illegal demand and torture and, therefore, I am not inclined to grant privilege of bail to the petitioner and accordingly, his prayer for bail in connection with Mashrak P.S.Case No. 236 of 2013 pending in the Court of Judicial Magistrate, 1st class, Saran at Chapra stands rejected.
