The petitioner is accused in connection with Digha P.S. Case No. 175 of 2010 registered under Sections 302 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather in course of investigation, police got recorded the confessional statement of coaccused, Subodh Subodh and Anil Kumar, who disclosed that at the time of occurrence, petitioner was present there, except that there is nothing against the petitioner showing his involvement in the present case. It is further submitted that petitioner is accused in other another case, in which, he is on bail and in the present case,
Patna High Court Cr.Misc. No.1913 of 2017 (2) dt.20-01-2017 he is in custody since 28.10.2016.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Patna, in connection with Digha P.S. Case No. 175 of 2010. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
