The petitioner apprehends his arrest in Parsa Bazar P.S. Case No. 366 of 2021, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act. Prosecution case in brief is that on the alleged date and time of occurrence co-accused Radhe Raman came at the door of informant and started abusing him. When the informant came out of the house co-accused Madhusudhan Gope armed with pistol started firing. In the meantime, petition along with co-accused Rakesh Kumar and some unknown persons armed with lathi, danda came there and threatened to kill him as well as started brick batting on the house of informant. Patna High Court CR. MISC. No.9997 of 2022(2) dt.08-08-2022 2/2 bullet was found in front of the door of informant. It is submitted that petitioner has been falsely implicated in this case. There is general and omnibus allegation. Specific allegation of firing is against co-accused. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIIIth, Patna in connection with Parsa Bazar P.S. Case No. 366 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
