The petitioner seeks bail in Dagarua P.S. Case No.72 of 2016 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code. It has been submitted that there is a case and counter case. The full brother of the informant has also filed a case i.e. Dagarua P.S. Case No.73 of 2016 against the informant of this case and others for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code. As per the allegation, the petitioner has allegedly assaulted the informant by farsa on his head. The injury report has been enclosed as Annexure-3 which shows that the doctor after

Patna High Court Cr.Misc. No.3723 of 2017 (2) dt.09-02-2017 C.T. scan found the brain to be normal. The doctor opined the injury as simple in nature due to hard blunt substance. The petitioner is said to be in custody since 19.10.2016. In the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-2nd, Purnea in connection with Dagarua P.S. Case No.72 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
