JUSTICE RAKESH KUMAR ORAL ORDER 18-07-2016 The sole petitioner, who at the relevant time was Circle Officer, has approached this court invoking its inherent jurisdiction under section 482 of the Code of Criminal Procedure with a prayer to quash an order dated 25.2.2013 passed by learned Sub Divisional Judicial Magistrate, Raxaul at Motihari in connection with Complaint Case No. 566 of 2011/ Tr. No. 3300 of 2013. By the said order the learned Magistrate has taken cognizance of offence under section 420 , 468, 471 of the Indian Penal Code. In the complaint petition it has been categorically alleged that petitioner had issued forged land possession certificate in favour of one of the co -accused and thereafter

Patna High Court Cr.Misc. No.27851 of 2013 (4) dt.18-07-2016 2/2 huge amount to the tune of Rs. 1,22,423/- was misappropriated. The order whereby cognizance has been taken for the offence suggests no error warranting interference.

The petition stands dismissed.
