The petitioner has been arrested in connection with Ramgarhwa P.S. Case No. 23 of 2012 (N.D.P.S. Case No. 35 of 2012) registered under Sections 20(b), 22, 23 and 24 of the N.D.P.S. Act with regard to recovery of 105 KG. Ganja from the possession of the petitioner which is more than commercial quantity of Ganja.
Learned counsel for the petitioner submits that the vehicle from which Ganja was recovered, was hired and the petitioner is simply driver of the said vehicle and he has no concern with the recover Ganja.
Having regard to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.32566 of 2014 (2) dt.05-08-2015 Ganja recovered is more than commercial quantity, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for bail is hereby rejected.
However, the trial court is directed to expedite the trial for early disposal of the case.
