The petitioner who is in custody in connection with Deo P.S. Case No. 53 of 2015 registered for the offence under Section 121, 121(A), 386, 120(B)/34 of the Indian Penal Code , Section 17 of the C.L.A. Act and Section 38 , 39, 40 of the U.A.P. Act has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner is having clean antecedent and out of five atleast three accused persons who were named in the F.I.R. similar to the petitioner have already been granted bail vide Cr. Misc. No. 51597 of 2015 on 10.11.2015.

Learned A.P.P. has opposed the prayer of bail.

Patna High Court Cr.Misc. No.55370 of 2015 (2) dt.18-12-2015 2/2 Keeping in view the fact that in similar situation other three F.I.R. named accused have been granted bail by this court, there is no reason to deny the prayer for bail to the petitioner. Let the petitioner Mithilesh Kumar @ Mithilesh Yadav @Mithlesh Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Deo P.S. Case No. 53 of 2015.
