Petitioner, namely, Shyam Sunder Bhagat is in custody in Salkhua P.S. Case No.191 of 2015 under sections 366A and 120B of the Indian Penal Code.

According to the prosecution case, the petitioner along with other co-accused person Rahul Bhagat and another kidnapped the informant's daughter.

The learned counsel for the petitioner submitted that the daughter of the informant has been recovered and her statement under Section 164 Cr.P.C. has been recorded wherein she has categorically stated that she from her own will married with Rahul.

In view of the above facts and circumstances of the case

Patna High Court Cr.Misc. No.55560 of 2015 (2) dt.14-12-2015 I direct the petitioner named above to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- II, Saharsa in connection with Salkhua P.S.
