JUSTICE RAKESH KUMAR ORAL ORDER 18-12-2015 Heard Sri Uday Pratap Singh, learned counsel for the petitioner and learned Special Public Prosecutor. The petitioner, who is in custody in connection with Bihta P.S. Case No. 498 of 2014 registered for the offence under Section 302/ 34 of the Indian Penal Code as well as Section 3( 2) (V) (X) of the Scheduled Case and Scheduled Tribe (Prevention of Atrocities) Act has prayed for grant of bail. Learned counsel for the petitioner submits that it was a case of land dispute and petitioner has already remained in jail for sufficient period.

On aforesaid grounds a prayer has been made for grant of bail.

Learned Special Public Prosecutor submits that in the

Patna High Court Cr.Misc. No.55344 of 2015 (2) dt.18-12-2015 2/2 F.I.R. itself main accusation has been leveled against the petitioner.

In view of the fact that petitioner is the main assailant, there is no reason to extend the privilege of bail to the petitioner. The petition stands dismissed.
