JUSTICE SUDHIR SINGH ORAL ORDER 08-02-2021 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner is apprehending his arrest in a case registered under Sections 341, 342, 323, 354, 354(A) and 34 of the Indian Penal Code.

Prosecution allegation, in short, is that the accused person allured the victim on the assurance of giving her a house under Indira Aawas Yojna.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case for oblique reason. The allegation made in the

Patna High Court CR. MISC. No.10103 of 2020(3) dt.08-02-2021 2/2 F.I.R. is denied by the petitioner. The petitioner did not misbehave with the victim. The victim, in order to put pressure for getting her name entered in the same scheme, has got the present case instituted against the petitioner. On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Siwan in connection with Barharia P.S. Case No. 399 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) Pankaj/- U T
