In this case, the petitioner is seeking anticipatory bail in connection with Bagaha (Pathkhauli) P.S. Case No. 504 of 2018, registered for the offence punishable under Sections 341, 323, 353, 379 and 504/34 of the Indian Penal Code. The petitioner is the owner of the tractor, used to carry the forest woods. When the Forest personnel intercepted the tractor, the accused persons fled away and later on, Baliram Choudhary, came and assaulted the informant.

It has been submitted by learned counsel for the petitioner that for the same incident one another case has also been lodged against the petitioner.

Looking to the entire facts and circumstances of the

Patna High Court Cr.Misc. No.11039 of 2019(2) dt.25-02-2019 2/2 case, let the petitioner, namely, Adarsh Shukla, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M., 1st Bagaha, West Champaran, in connection with Bagaha (Pathkhauli) P.S. Case no. 504 of 2018 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation.

In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled. This is also subject to the condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases, then the cornered Court below would be at liberty to take steps for cancellation of his bail bonds.
