Petitioner seeks bail in Siwan Mahila P.S. Case No. 61 of 2016 instituted under Section(s) 341, 323, 506, 354-D, 376, Indian Penal Code pending before the Sub-Divisional Judicial Magistrate, Siwan.

As per written report, there is specific allegation against this petitioner of committing rape with the informant and taking her naked photograph on mobile phone and the petitioner gave threat to the informant that he will send it on internet, if she will raise halla.

Case diary has been received.

Learned APP has submitted that the witnesses have supported the case of the informant in the case diary. The

Patna High Court Cr.Misc. No.7101 of 2017 (4) dt.03-04-2017 2/2 informant in her re-statement has supported the allegation against the petitioner.

It has been submitted on behalf the petitioners that there is counter case also and this case has been filed on account of enmity.

Keeping in view the serious allegation against the petitioner, I am not inclined to grant bail to him. Prayer for bail is rejected.
