JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-06-2020 Heard Mr. Satya Prakash Parasar, learned counsel appearing for the petitioner, Mr. Ajay Kumar Jha, learned Additional Public Prosecutor for the State and Ms. Mira Kumari learned counsel for the informant through video conferencing. Petitioner seeks bail in connection with Jamui P.S. Case No. 563 of 2019 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, his name surfaced and it came to light that petitioner was in constant touch with co-accused Niraj Kumar through mobile phone and, furthermore, it came to light that the location of mobile phone of the petitioner was found adjacent to the place from where the dead body of the deceased was recovered.

No.7986 of 2020(3) dt.08-06-2020 2/2 Learned counsel appearing for petitioner submits that except the aforesaid material, there appears to be nothing against the petitioner, who does not have any criminal antecedent and, moreover, the investigation against him has already been completed.

Although, learned Additional Public Prosecutor as well as learned counsel for informant opposed the prayer but considering the above stated facts and also taking note of this fact that the petitioner does not have any criminal antecedent and is languishing in jail custody since 4.1.2020, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Jamui/concerned court in connection with Jamui P.S. Case No. 563 of 2019.
