JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-02-2017 The petitioner is in custody since 10.11.2016 in connection with Kotwali P.S. Case No. 533 of 2016, registered for offences punishable under Sections 30(a), 32(2), 41(1) of Bihar Prohibition & Excise Act.

It has been submitted on behalf of the petitioner the petitioner happens to be the driver of the vehicle from which the alleged 78 litres of liquor has been recovered and he has nothing to do with the said recovered and for that he has been in judicial custody since 10.11.2016.

Heard learned A.P.P. also.

Having heard both sides, in view of the fact that huge quantity of liquor has been recovered from the possession of the petitioner, I am not inclined to grant the petitioner, the privilege of

Patna High Court Cr.Misc. No.2843 of 2017 (2) dt.09-02-2017 2/2 regular bail at this stage.

However, the petitioner may renew his prayer for bail after completion of six months in judicial custody before the court below, who shall dispose of the same on the merit of the case as well as considering the period of detention of the petitioner. (Vinod Kumar Sinha, J) sunil/- U
