JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 168(O) of 2018 registered for the offence punishable under Section 30(a) of Bihar Excise (Amendment) Act, 2018.

Allegation is of recovery of 16.920 litres of liquor from the house of the petitioner.

Submission of learned counsel for the petitioner is that FIR itself shows that the house is abandoned house of the petitioner and he has falsely been implicated in this case and he has no criminal antecedent.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest

Patna High Court Cr.Misc. No.11300 of 2019(2) dt.25-02-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District JudgeII-cum-Special Judge, Excise, Buxar, in connection with Excise Case No. 168(O) of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
