Petitioner seeks bail in connection with Begusarai Town P.S. Case No. 195 of 2016 registered under Sections379, 402 of the Indian Penal Code, section 25(1-b)a, 26, 35 of the Arms Act and sections 53A & 54 of the Bihar Excise Amendment Act.

Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. No independent witness was there during the alleged search and seizure. Petitioner is in custody since 23.04.2016. Similarly situated co-accused persons have been granted bail by this Court vide orders dated 24.11.2016,

Patna High Court Cr.Misc. No.4213 of 2017 (2) dt.08-03-2017 2/2 23.12.2016, 23.02.2017 and 01.03.2017 passed in Cr. Misc. No. 50685 of 2016, 54633 of 2016, 3927 of 2017 and 3704 of 2017 respectively.

Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 195 of 2016.
