2. In the agreement entered between the parties, there is arbitration Clause which is as under;
"ARBITRATION In case of any dispute DOT, GOB may appoint an arbitrator, which will be accepted by the agency/firm. The decision of the arbitrator will be final and binding on both the parties. The jurisdiction of the court will be Patna (Bihar)."
3. Having regard to the above Clause in the
Patna High Court CWJC No.2970 of 2024(3) dt.22-07-2024 2/2 agreement, this Court is not inclined to entertain the present writ petition. The petitioner is directed to approach the arbitrator within a period of four weeks from today. It is made clear that this Court has not gone into the merits of the case and leaving all issues to be raised by the parties and to be decided by the arbitrator.
4. With the above direction, the present writ petition stands disposed of.
