The petitioner seeks bail in a case registered under Sections 363, 366 of the Indian Penal Code and Section-8 of the POCSO Act.

Allegation against the petitioner is of kidnapping the informant's daughter.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 13-12-2018. Charge sheet has already been submitted. There was love affairs between the victim and the petitioner. The victim had left home with her own sweet will. When she came in custody of her parents, under

Patna High Court CR. MISC. No.9390 of 2019(4) dt.15-04-2019 2/2 inducement she made statement under Section 164 of the Cr.P.C. No sexual or physical assault is alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cum-Special Judge, Bettiah, West Champaran in connection with S.G.R. Case No. 215 of 2018 arising out of Sahodara P.S. Case No. 87 of 2018.
