JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State as well as learned counsel for the informant.

The petitioner, who is the mother-in-law of the daughter of the informant, is apprehending arrest in connection with Chanan P.S. Case No. 33 of 2018 for offences under Sections 498A, 341, 323, 364, and 504/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

The allegation against the petitioner is that marriage of daughter of the informant with son of the petitioner took place in the year 2015. It is alleged that the petitioner and his family members have tortured the daughter of the informant for non-fulfillment of dowry demand.

No.8086 of 2020(2) dt.03-03-2020 2/2 Considering the fact that the petitioner is the motherin-law of the daughter of the informant, this Court is inclined to grant bail to her. Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1st, Lakhisarai in connection with Chanan P.S. Case No. 33 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. subject to the condition that the petitioner has to take initiative for restoration of conjugal life of her son with daughter-in-law and will ensure stay of the daughter-in-law with full honour and dignity.

In the event the petitioner and her other family members neglect, misbehave or torture the daughter of the informant, the court below shall be at liberty to cancel her bail bond.
