Patna High Court CWJC No.3091 of 2020(3) dt.01-08-2023 2/2 absent himself, learned counsel on behalf of the Bank (respondent no. 7) took this Court to the proceeding of the PACS as contained in Annexure-2 to the writ petition from which it is clear the earlier account which is continuing in the name of the Chairman and the Manager with the respondent no. 7, Bank was to be operated upon.
It is his contention they deviating from that, the petitioner wanted to open a fresh account in his own name and accordingly, made an application on 15.01.2022. As the same is contrary to the proceeding and already the said PACS is having an account, his application was not entertained. This Court is convinced with the submissions put forward by the Bank. When the PACS of Walidad, Kaler, Arwal. is already having an account in the Bank and the proceeding also says the same, there was no occasion for the petitioner to open another account in his own name.
The writ petition is misconceived and is accordingly, dismissed.
