JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 13-06-2022 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Salimpur P.S. Case No. 89 of 2021 registered for the offence under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.

The accused/petitioner is named in the F.I.R. and is in custody since 24.11.2021.

The allegation against the petitioner is to assault the informant alongwith other co-accused with deadly weapons like fire arms etc.

No.10496 of 2022(2) dt.13-06-2022 2/3 Learned counsel appearing on behalf of the petitioner submitted that the allegation as regard to assault against this petitioner is very much omnibus in nature rather the same is specific against the co-accused, namely, Sujeet Singh. It has further been submitted that petitioner is on bail in all two criminal cases which is mentioned in paragraph no.3 of the bail petition.

Learned APP appearing on behalf of the State, duly assisted by learned counsel appearing on behalf of the informant, Shri Manoj Kumar Pandey, fairly conceded the fact that the nature of allegation as regard to the assault against the petitioner is omnibus.

Considering the facts and circumstances as mentioned above, as the nature of allegation as regard to assault against the petitioner is very much omnibus, let the petitioner, above named, is directed to be released on bail in connection with Salimpur P.S. Case No. 89 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Barh, Patna, subject to the following conditions: "(i) Accused/Petitioner shall cooperate in the trial and shall be properly
