The petitioner apprehends his arrest in a case registered for the offence punishable u/s 420, 34 and 120B of the IPC. 3.

Allegedly, the F.I.R. named accused persons including the petitioner are said to have cheated Rs.20,16,800/- from the informant on the pretext of giving HDFC life policy. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to ulterior motive. No such occurrence, in the manner as alleged, has ever taken place. Allegation against the petitioner is that he is the staff of the HDFC Bank and on his request, the informant has taken one

Patna High Court CR. MISC. No.10910 of 2023(4) dt.24-08-2023 2/2 insurance of HDFC life policy but there is no specific overt act the petitioner in the entire case diary. Petitioner is an employee of the HDFC Bank not of HDFC Life. The informant got several calls from fake people, who cheated her money. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail by submitting that there is allegation against the petitioner of taking Rs.2,70,000/- for the insurance from the informant. 6.

Having regard to the facts and circumstances of the case, since there is no specific overt act against the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Sri Krishnapuri P.S. Case No.132/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
