The petitioner claims to have retired from the post of University Professor on 31.03.1992. Petitioner claims that having crossed 86 years of age, he is entitled for payment of additional pension in terms of Clause 2 of the resolution of the Education Department, State of Bihar, a copy of which has been appended as Annexure 2. It is contended that the pensionar, if attains the age of more than 80 years and less than 85 years, would be entitled for

If he crosses the age of 85 then he would be entitled for additional pension at the rate of 30%. The aforesaid amount has not been calculated and paid to the petitioner even though a representation to that effect was given to the Registrar as well as the Vice Chancellor of the University, a copy of the representation has been appended as Annexure 4 series.

Accordingly, this writ application is being disposed of with a direction to the respondent no.3, the Registrar, Tilka Manjhi Bhagalpur University, Bhagalpur to get the calculation made with respect to the additional pension if the same is found admissible to the petitioner and ensure payment of the said amount in favour of the petitioner within a period of three months from the date of receipt/production of a copy of this order.
