Petitioner is seeking anticipatory bail in connection with Brahmpur P.S. Case No. 464 of 2018 registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)A/26/35 of the Arms Act. Learned counsel for the petitioner submits that the name of the petitioner has transpired in the statement of the apprehended accused. It is submitted that save and expect that statement of the apprehended accused, there is nothing incriminating against the petitioner. Learned counsel submits that it is a case of false implication and in absence of any material on the record, the prayer for anticipatory bail of the petitioner has been refused by the learned court below.

No.12505 of 2019(2) dt.05-03-2019 2/2 On perusal of the impugned order, it appears that the learned Sessions Judge has rejected the prayer for anticipatory bail on the ground that the investigation is still pending. In the nature of the submissions, considering that the name of the petitioner has transpired in the statement of apprehended accused, let in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfication of the learned Chief Judicial Magistrate, Buxar in connection with Brahmpur P.S. Case No. 464 of 2018, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C. (Rajeev Ranjan Prasad, J) arvind/- U T
