The petitioner is accused in connection with Muffasil P.S. Case No. 310 of 2015 registered under sections 147, 148, 149, 307, 326 and 302 of the I.P.C. and 27 of the Arms Act pending in the Court of C.J.M. Begusarai.
Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case due to land dispute. It is also submitted that petitioner has no concerned with the alleged occurrence and he is in custody since 26.06.2016.
Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission
Patna High Court Cr.Misc. No.3338 of 2017 (3) dt.04-04-2017 2/2 that there is direct allegation of firing upon the deceased against the petitioner.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Arvind Srivastava, J) Shailendra/- U T
