2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 303 (2) of the BNS.
3. The case of the prosecution, in short, is that unknown thieves have stolen the informant's motorcycle bearing Registration No. BR01FN-2444, a blue colour Apache.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the F.I.R. was lodged against unknown miscreants. During the course of investigation, one Guddu is said to have made a confessional statement, in which the name of the present

It is submitted that no recovery has been made from the possession of the petitioner and, save and except the confessional statement of the co-accused Guddu, there is nothing against him. It is further submitted that the petitioner has criminal antecedents in four cases and that those antecedents are also based on confessional statements. The petitioner is in custody since 28.06.2025.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Masaurhi P.S. Case No. 490 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Masaurhi.
