2. The petitioner apprehends arrest in connection with Jagdishpur PS Case No.324 of 2024 dated 21.09.2024, instituted under Sections 318(4), 336(2), 336(3), 338, 340(2), 351(2), 352 of the Bhartiya Nayaya Sanhita, 2023.
3. The allegation against the petitioner is that the petitioner along with other accused persons got a deed executed in favour of Sagir Ahmad after administering some poisonous substance to the informant's husband. The petitioner was one of the witnesses of the sale deed.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.8877 of 2025(6) dt.21-02-2025 2/3 only allegation against the petitioner is that he is the witness of the sale deed dated 01.08.2024. Learned counsel for the petitioner further submits that the present case has been filed by the wife of the vendor, who is alive till date, but no complaint has been made by the husband of the informant. Further submission is that the dispute is purely civil in nature. It is also submitted that similarly situated co-accused, Seth Kumar, and Sagir Ahmad @ Md. Sagir Ahmad in whose favour deed was executed, have been granted anticipatory bail by this Court by order dated 11.12.2024 passed in Cr. Misc. No.83690 of 2024. Lastly, it is submitted that the petitioner has no criminal antecedents.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IX, Bhojpur at Ara, in Jagdishpur PS Case No.324 of 2024, subject to the conditions laid down in Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
