JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 406 of the Indian Penal Code.

Prosecution case is that the petitioner is a registered contractor whereas Ashok Kumar Singh, Pappu Singh and the informant were petty contractor under petitioner. The Total due amount, for the construction work done by them came to rupees ten lacks out of which the petitioner issued a cheque of Rs.1,80,000/- in favour of informant's partner Ashok Kumar Singh and rest Rs.8,20,000/- were not paid by him. On demand being made, the accused persons gave life threatening to the informant. It is submitted by learned counsel for the petitioner that accusation has been levelled in the background of contractual

Patna High Court Cr.Misc. No.3055 of 2016 (2) dt.19-01-2016 2/2 nature of dispute between the petitioner and the informant and at earlier point of time petitioner's side lodged Pakridayal P.S. Case No.79/2015 against the informant and others.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari in connection with Pakaridayal P.S. Case No.98/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
