====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 25-02-2019 Heard learned counsel for the petitioners and the State.

The petitioners seeks bail in Case No. C2-04/19, instituted for the offence under Section(s) 30(a) of Bihar Prohibition & Excise Act, 2016.

It is alleged in the written report that Police intercepted one Tyota vehicle bearing registration No. DL3CV7598 and petitioners have been arrested. One co-accused Ravindra Rai managed to run away. Police recovered 420.480 liters of foreign liquor from the vehicle. It is further alleged that petitioners are drivers of the aforesaid vehicle. Counsel for the petitioners submits that petitioners

Patna High Court Cr.Misc. No.11106 of 2019(2) dt.25-02-2019 2/2 have no concern with the alleged illicit liquor. The recovery of illicit liquor belongs to one Ravindra Rai who managed to run away from the place of occurrence.

Petitioners are in custody since 6.1.2019 and 07.01.2019 respectively having clean antecedent. Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Sitamarhi, in connection with Case No. C2-04/19, subject to the condition that both the bailors will be the close relatives of the petitioners.
